PLEASE READ THESE TERMS CAREFULLY BEFORE USING PARALLEL KINGDOM 2. YOU ACCEPT THESE TERMS OF SERVICE ("TERMS") BY CHECKING THE BOX OR CLICKING THE BUTTON THAT SAYS YOU AGREE TO THEM WHEN YOU SIGN UP OR SIGN IN, OR BY USING OUR PRODUCTS.
These Terms include:
- the Community Rules in Appendix A;
- the Promotions and Referral Program Official Rules in Appendix B;
- any other terms referenced in these Terms;
- the payment and subscription renewal provisions in Section 7; and
- the mandatory arbitration provisions in Section 17.
IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING, YOU MAY NOT USE OR ACCESS THE PRODUCTS IN ANY MANNER.
IMPORTANT NOTICE OF CLASS ACTION WAIVER AND ARBITRATION PROVISION: YOU AND PERBLUE AGREE TO RESOLVE MOST DISPUTES BY BINDING, INDIVIDUAL ARBITRATION AND NOT AS A CLASS ARBITRATION, CLASS ACTION, ANY OTHER KIND OF REPRESENTATIVE PROCEEDING, OR BY JURY TRIAL. IF YOU DO NOT WISH TO ARBITRATE DISPUTES WITH PERBLUE, YOU MAY OPT OUT OF ARBITRATION BY FOLLOWING THE INSTRUCTIONS PROVIDED IN SECTION 17(M) BELOW.
The short version. These Terms are a contract, and the full text controls. In plain words:
- You must be 18 or older.
- Parallel Kingdom 2 is set on a map of the real world. Your characters' locations are their locations in the game, and they may or may not match where you are. Character locations are public in the game world: there is no hidden mode, and other players can see what you do there. Stay safe, obey the law where you are, and never play while driving.
- Chat and messages are not private. We store them, and our staff and automated tools may review them.
- We use AI. Your content, chat, messages and game data may be processed by AI service providers.
- In-game items and currencies, including Food, Gold and Roc Feathers, are a license, not property, and have no cash value.
- Any API we offer must be used within these Terms. Unauthorized bots, scraping and cheating are banned.
- Ideas you send us, and things you build with our tools, belong to us. We have a broad license to your other content.
- Disputes go to individual arbitration, unless you opt out within 30 days.
These Terms govern your use of Parallel Kingdom 2, including:
- the game and its web client, on parallelkingdom.com and any of its subdomains;
- the Parallel Kingdom 2 websites, including parallelkingdom.com and its campaign pages;
- any application programming interface we offer for Parallel Kingdom 2 (the "API");
- our emails and support;
- features, events, contests and promotions; and
- any future Parallel Kingdom 2 apps.
Together these are the "Products". They are provided by PerBlue Entertainment, Inc., a Delaware corporation ("PerBlue", "we", "us" or "our").
By using any Product, you agree to be bound by and comply with these Terms, and you acknowledge receipt of our Privacy Policy, available on our website. If you do not agree to these Terms or our Privacy Policy, do not use our Products.
The Terms apply regardless of the device used to access the Products. That includes a personal computer, mobile device, tablet, console, other consumer electronics device, or any other technology or software known today or developed in the future ("Device").
Except as set forth in Section 17, we may revise these Terms at any time and in our sole discretion. The most current version of these Terms will always be posted on our website, with its "Last Updated" date. You are responsible for reviewing and becoming familiar with any revisions.
If a revision is material, in our sole discretion, we will notify you by e-mail to the address on your account, by a notice in the Products, or both. Unless a change is required sooner by law, or to address a safety or security issue, a material revision takes effect no sooner than 14 days after we send that notice. We may ask you to accept revised Terms, by checkbox or button, before you continue playing.
By continuing to use our Products after those revisions become effective, you agree to be bound by and comply with the revised Terms. If you do not agree to them, stop using our Products; you may delete your account (Section 14).
Changes to these Terms do not change the Official Rules of a promotion that has already opened (Appendix B, Part 1).
You may be required to agree to an additional governing agreement in order to use, access or download our Products. Examples are a terms of use, end user license agreement, privacy policy, or contest, sweepstakes or promotion terms (each, an "Other Governing Agreement"). If an Other Governing Agreement conflicts with these Terms, the Other Governing Agreement governs. Notwithstanding the foregoing, Section 17 of these Terms will govern to the extent there is a conflict between it and any Other Governing Agreement.
1. Our Users#
You may use our Products only if you can form a binding contract with PerBlue and are not a person barred from receiving our Products under the laws of the United States or other applicable jurisdictions.
YOU MUST BE AT LEAST 18 YEARS OLD, AND THE LEGAL AGE OF MAJORITY IN YOUR COUNTRY, STATE OR PROVINCE OF RESIDENCE, TO CREATE AN ACCOUNT OR USE PARALLEL KINGDOM 2. ANY ACCESS OR USE BY ANYONE UNDER 18, OR BY ANYONE LOCATED IN A RESTRICTED TERRITORY, IS PROHIBITED. BY ACCEPTING THESE TERMS, YOU CONFIRM THAT YOU ARE AT LEAST 18, HAVE REACHED THE LEGAL AGE OF MAJORITY, AND UNDERSTAND AND ACCEPT THESE TERMS, INCLUDING THEIR DISPUTE RESOLUTION TERMS.
Parallel Kingdom 2 is not directed to children. We may suspend or close an account if we believe its holder is under 18. If you believe someone under 18 is using our Products, tell us at [email protected].
We may make the Products available only in certain countries or regions. During the beta, the Products are offered only to residents of the United States. Do not use the Products where they are not offered.
You represent that you are not located in, under the control of, or a national or resident of any country subject to a comprehensive U.S. embargo, and that you are not on any U.S. government list of prohibited or restricted parties.
If you are accepting these Terms and using our Products on behalf of a company, organization, government or other legal entity, then "you" includes you and that entity. You confirm that you are authorized to bind that entity to these Terms and our Privacy Policy, and you agree to them on that entity's behalf.
2. Your Use#
(A) YOUR RESPONSIBILITY#
You are responsible for:
- your account, the characters on it, and the email address you sign in with;
- any API access issued for your account;
- your use of our Products and any consequences of that use; and
- your compliance with these Terms (including the Community Rules) and our Privacy Policy.
Account. You sign in to Parallel Kingdom 2 with an email address. We send a one-time sign-in link to it, and we may add other sign-in methods later. Anyone who can read your email can sign in as you, so keep your email account secure.
When you create an account or user profile with PerBlue, or submit any forms to PerBlue, you provide information such as your email address and your confirmation of your age ("Registration Data"). You agree to provide complete, accurate and up-to-date Registration Data, and to update it to keep it complete and accurate. If you provide information that is inaccurate, not current or incomplete, or if PerBlue has reasonable grounds to suspect that it is, PerBlue may, at its sole discretion, deny you access or terminate your account.
You may use our Products only in compliance with these Terms, our Privacy Policy and all applicable laws, rules and regulations.
Characters and names. An account can hold up to the number of characters we allow, currently five. You control every character on your account, and you are responsible for its actions, however they are taken, including through the API.
You are responsible for ensuring that the names you choose do not infringe any third party's rights and are not otherwise unlawful. This covers character names, plot names and any other names or text. We may refuse or revoke a name, or rename a character or plot, in our sole discretion and for any reason, including if the name:
- impersonates someone, or misleadingly implies an association with another person or entity;
- is or may be illegal;
- is or may be protected by trademark or other proprietary rights;
- is vulgar or otherwise offensive;
- contains personal information; or
- may cause confusion.
The name rules are in the Community Rules (Appendix A, Part 3).
Original Parallel Kingdom names. We may let players of the original Parallel Kingdom (2008) reserve or reclaim a character name they used there, under the process and verification steps we publish (Appendix A, Part 3). A reserved or reclaimed name:
- is a name in the current game only;
- is subject to these Terms like any other name; and
- gives you no other right in the name or in anything from the original game.
Original Parallel Kingdom accounts, items, currency, purchases, progress and territory do not carry over. We decide claims in our discretion, and we may release names that are not claimed.
YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR REGISTRATION DATA, YOUR SIGN-IN LINKS AND ANY API CREDENTIALS ISSUED FOR YOUR ACCOUNT. YOU ARE ALSO ENTIRELY RESPONSIBLE FOR ALL ACCESS TO AND USE OF YOUR ACCOUNT, INCLUDING ANY AND ALL ACTIVITIES THAT ARE CONDUCTED, AND ANY FEES OR CHARGES THAT ARE INCURRED, THROUGH THEM OR THROUGH YOUR ACCOUNT, WHETHER OR NOT AUTHORIZED BY YOU.
You may not use anyone else's Registration Data, sign-in links, API credentials or account at any time. You may not allow anyone else to use your account, sign-in links or API credentials at any time. We will not be liable or responsible for any loss you may incur as a result of someone else using your Registration Data, API credentials or account, with or without your knowledge. You will be liable for losses incurred by us or another party because someone else used your Registration Data, API credentials or account.
You will notify PerBlue immediately of any unauthorized use of, or any other breach of, your Registration Data, API credentials or account. PerBlue may require you to change your Registration Data, may unilaterally change it, and may revoke any session or API credential at any time.
You may establish, maintain, use and control only one account. Each account may only be owned, maintained, used and controlled by one individual. For avoidance of doubt, users may not "co-own" accounts or share one account among several people. If PerBlue determines that you have opened, maintained, used or controlled more than one account, PerBlue reserves the right, in addition to any other rights it may have, to:
- suspend or terminate any or all of your accounts;
- reverse any Virtual Items or Virtual Currency moved between them; and
- terminate, withhold or revoke the awarding of any prizes or rewards.
You agree that the sole and specific purpose of registering an account is to use our Products.
You acknowledge, consent and agree that PerBlue may access, preserve and disclose your Registration Data, your Submissions (defined below) and your Communications (Section 4(C)) if we believe it is appropriate or necessary to:
- enforce these Terms, our Privacy Policy, any Other Governing Agreement, or any other agreement with you;
- take precautions against liability or fraudulent, abusive or unlawful uses;
- investigate, respond to and defend ourselves against third-party claims or allegations;
- respond to court orders, judicial or other official government requests, subpoenas or warrants;
- comply with U.S. state and federal laws and regulations, including sharing with appropriate tax authorities, or with other applicable laws around the world (for example, in the country of your residence);
- protect the security or integrity of our Products;
- respond to your requests for customer service;
- report violations of PerBlue's eligibility rules to third parties; and
- protect the rights, property or safety of PerBlue, our employees, our users or others.
(B) YOUR DEVICE#
You represent and warrant that you own or control the Device you use to use our Products. You understand that airtime, data, messaging and other charges from the provider of your Device may apply, and it is your responsibility to determine what costs apply and to pay them. It is also your responsibility to determine whether your Device and its browser, location services and settings are compatible with our Products. We do not make any representations, warranties or guarantees that our Products will be compatible with, or accessible by, your Device.
(C) YOUR INFORMATION#
You acknowledge and agree that we may collect, use and/or disclose for our business and other legitimate purposes data and information regarding you, your Device and your use of our Products in accordance with these Terms and our Privacy Policy.
You consent to receive notifications from PerBlue electronically, including e-mails and other types of communication from PerBlue via the Products, or using the e-mail address or other contact information you provide in connection with the Products. Some of these messages are needed to run your account and are not marketing, so you cannot opt out of them while you have an account. Examples are sign-in and verification links, security notices, purchase receipts, notices about these Terms, and replies from support. Marketing email is optional and has its own unsubscribe link.
You agree that all notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing or be delivered in a particular manner. You agree to keep your e-mail address information current.
For information about how we collect, use, share and otherwise process information about you, please see our Privacy Policy linked above.
(D) YOUR FEEDBACK AND IDEAS#
We appreciate your feedback, ideas and suggestions about Parallel Kingdom 2, PerBlue and our Products, which you have no obligation to offer. That includes bug reports, game design ideas, balance suggestions, names, story, art or level ideas, feature requests, and content of that kind you send to us. It does not matter how you send it: in game chat, the support inbox, email, surveys, our community channels, playtests, or any other way. We call all of this "Feedback".
Unsolicited ideas. PerBlue and its staff create games and continually develop ideas of their own. Many ideas we receive will be similar to things we are already working on or will work on independently. To avoid misunderstandings, please do not send us ideas you want to keep confidential or be paid for. If you voluntarily choose to provide Feedback:
- The Feedback is not confidential, and no confidential, fiduciary or implied-contract relationship is created between you and PerBlue.
- We have no obligation to review, use, credit, or pay for the Feedback.
- Assignment. To the fullest extent permitted by law, you hereby assign to PerBlue all right, title and interest, including all intellectual property rights, in and to the Feedback. This includes the right to use, change, combine, commercialize and register it in any way, without any compensation or other obligation to you.
- Fallback license. If and to the extent any such assignment is not effective under applicable law, you hereby grant PerBlue an irrevocable, perpetual, exclusive (or, where exclusivity is not permitted, non-exclusive), worldwide, royalty-free, fully paid up, sublicensable (through multiple tiers) and transferable license to:
- access, use, store, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, sell, perform, process, transmit and display the Feedback; and
- otherwise exploit it in any and all media now known or later developed.
- Waiver. To the fullest extent permitted by law, you irrevocably waive, and cause to be waived, against PerBlue, its licensees and its users, any claims of moral rights, attribution rights or rights of integrity in your Feedback. You also agree not to assert any such rights.
- You agree to sign any documents reasonably needed to confirm PerBlue's rights in Feedback, and you appoint PerBlue as your attorney-in-fact to sign them if you do not.
This Section does not apply to ideas we receive under a separate written agreement signed by PerBlue, which will govern instead.
(E) NOTICE TO USERS OUTSIDE THE UNITED STATES#
Our Products are hosted and operated in the United States. If you access our Products from outside the United States, where we offer them, your information will be transferred to, stored in and processed in the United States and other countries where we or our service providers operate. Those countries' data protection laws may differ from your country's. Our Privacy Policy explains how we protect that information. We make no representations that our Products are appropriate or available for use in other geographic locations.
3. Your Permission to Use Our Products#
Subject to your compliance with these Terms and our policies, including our Privacy Policy, we grant you a non-exclusive, non-sublicensable, non-transferable, revocable, limited license to use our Products, including any API as described in Section 5(E), for your own personal, non-commercial entertainment use.
"Materials" means the data, text, pictures, graphics, audio, video, icons, map styles and map data compiled by us, content, features, links, software, and Virtual Items and Virtual Currency (each as defined below), available in, on or through our Products. It includes any game themes, plots, sequences and characters (including heroes, monsters and non-player characters), and other in-game items. You may use the Materials only when using our Products for your own personal, non-commercial entertainment use.
All right, title and interest in and to our Products, including the Materials and all intellectual property and proprietary rights in them, are and will remain the exclusive property of PerBlue and its licensors. This excludes the Submissions that you and other users retain rights in under Section 4, and third-party map data, which remains subject to its own licenses (Section 9(B)). PerBlue reserves all rights in and to our Products (including the Materials) not expressly granted to you under these Terms.
Nothing in these Terms gives you a right to use the Parallel Kingdom or PerBlue names or any of PerBlue's trademarks, trade names, trade dress, logos, service marks and domain names. Fan sites, videos and streams of Parallel Kingdom 2 are welcome under our fan content guidelines, which we will post on our website before launch.
4. Your Submissions#
(A) USE OF YOUR SUBMISSIONS#
You and other users may create, display, post, publish, share, submit or transmit content in or through our Products (collectively, "Submissions"). Submissions include:
- character names, plot names, profile information and appearances;
- chat messages in public and regional channels, direct messages, mentions, reactions and messages to support;
- map pings and other cards attached to messages;
- buildings, building layouts, walls, gates, decorations and other things you place on the map;
- trade listings and offers;
- reports you file;
- battle and raid records and replays that include your characters; and
- any other comments, notes or information regarding our Products or your use of or experiences with them.
Feedback is governed by Section 2(D).
Submissions may be public. Many Submissions can be seen by other users, and some can be seen by anyone on the web. For example:
- your character's name, profile and the land it holds may appear on a public profile page;
- a battle or raid replay can be shared by public link, and shows the names, base layout and in-game location of the plot involved;
- names appear on leaderboards, in trade feeds and in the in-game news; and
- what you build on a plot can be seen by anyone who views that place on the map.
You should only make available Submissions that you are comfortable sharing publicly and for which you have no expectation of privacy. PerBlue strongly encourages you not to make available Submissions that contain your personally identifiable information, your real address, or your confidential or proprietary information. Any Submissions will be deemed non-confidential.
You are responsible and liable for your Submissions, and you agree that they will not violate these Terms. You represent and warrant that:
- you either are the sole and exclusive owner of your Submissions, or you have all rights, licenses, consents and releases necessary to grant PerBlue and its users the rights in your Submissions contemplated by these Terms; and
- neither your Submissions, nor your creating, displaying, posting, publishing, sharing, submitting or transmitting them, nor the use of your Submissions (or any portion of them) on, through or by means of our Products, will:
- infringe, misappropriate or violate a third party's intellectual property rights, or rights of publicity or privacy; or
- result in the violation of any applicable law, rule or regulation.
License to PerBlue. By creating, displaying, posting, publishing, sharing, submitting or transmitting Submissions, you hereby grant PerBlue a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully paid up, sublicensable (through multiple tiers) and transferable license. It covers accessing, using, storing, copying, reproducing, modifying, adapting, translating, publishing, creating derivative works from, distributing, performing, processing (including with AI, as described in Section 4(D)), transmitting and displaying your Submissions. The license applies in any and all media or distribution methods, now known or later developed, for the purposes of developing, providing, operating, moderating, securing, improving, promoting and using our Products and PerBlue's other games and services.
This license includes the right for PerBlue to use, share or disclose your Submissions with companies, organizations or individuals that partner with PerBlue, and to further distribute your Submissions to a wider audience through third-party sites and services (for example, trailers, social media posts and screenshots that show the world). These uses may be made by or on behalf of PerBlue without any compensation or other obligation, whether of confidentiality, attribution or otherwise, to you. Nothing in these Terms will restrict other legal rights PerBlue may have to user Submissions, for example, under other licenses.
Account deletion. If you delete your account, we will stop displaying your profile and will remove or de-identify Submissions tied to your account as described in our Privacy Policy. However, the license above continues for Submissions that have become part of the shared world or of other users' records, such as:
- messages in shared conversations;
- replays;
- trade history;
- map history; and
- anything we have already used under the license.
Following termination of your use of our Products, we may also retain your Submissions for our business or other legitimate purposes, and for backup, archival or audit purposes.
License to other users. You also grant each other user a non-exclusive license to access your Submissions through the Products, and to use, reproduce, display and share them as the Products' features allow (for example, sharing a replay link). PerBlue's users may retain and continue to access, use, store, copy, reproduce, display and share any of your Submissions that other users have stored or shared.
(B) IN-GAME CREATIONS#
Many things you make in Parallel Kingdom 2 are built from our Materials using our tools. We call these "In-Game Creations". Examples are:
- the arrangement of buildings, walls, gates and decorations on your plots;
- character appearances and outfits assembled from our parts;
- army and hero lineups; and
- recorded battles and raids.
In-Game Creations are derivative works of the Products. As between you and PerBlue, PerBlue owns them. To the extent you have any rights in an In-Game Creation, you hereby assign them to PerBlue, and the waiver in Section 2(D) applies to them.
PerBlue grants you a license to use your In-Game Creations in the Products, and to share screenshots and videos of them for non-commercial purposes under our fan content guidelines. We may keep, show, change or remove In-Game Creations, including after a plot changes hands or the world is reset.
Your character names and the text you write (such as chat) are not In-Game Creations. They remain subject to the license in Section 4(A).
(C) COMMUNICATIONS ARE NOT PRIVATE; CONSENT TO REVIEW#
Parallel Kingdom 2 has public chat, regional chat, direct messages, mentions, a support inbox and other ways to communicate ("Communications"). Communications in our Products, including direct messages, are not private or confidential. By using them, you understand and consent to the following:
- We record and keep them. We store Communications on our servers, including messages you or others later delete or hide, for as long as described in our Privacy Policy.
- We review them. PerBlue staff, our contractors and automated tools may monitor, read, review, analyze and act on Communications. Automated tools include filters, classifiers and AI systems (Section 4(D)). They may do this at any time and for any lawful purpose, including to:
- moderate and enforce these Terms;
- investigate reports, cheating, fraud and abuse;
- protect the safety of players and others;
- answer support requests;
- comply with law and legal process; and
- operate, analyze and improve our Products.
- Reports keep a copy. When someone reports a message, we keep a copy of it with the report.
- Others see them. The people you message see your messages and may save or share them.
- We may disclose them. We may disclose Communications as described in Section 2(A) and in our Privacy Policy, including to law enforcement.
You have no expectation of privacy in Communications. Do not use them to share passwords, payment details, government ID numbers, your home address, or anything you would not want PerBlue or others to read.
(D) ARTIFICIAL INTELLIGENCE AND AI SERVICE PROVIDERS#
PerBlue uses artificial intelligence ("AI"), including large language models, to build, run, moderate and improve Parallel Kingdom 2.
What may be processed. To do this, we may send the following to AI service providers, or process it with AI models we host ourselves:
- your Submissions and other user content, such as names, profiles, plot names, and what you build or post;
- Communications, including public and regional chat, direct messages, mentions and messages to support;
- game content and game data, including information about your account and characters, such as their names, in-game positions and travel, land, holdings, trades, battles and other actions; and
- Feedback, reports and other information you send us.
Who. The AI service providers we use may include OpenAI, Anthropic and Google, or our own self-hosted large language models. We may add, remove or change providers at any time without notice to you. Our Privacy Policy describes how these providers are used.
Why. We may use AI, and AI service providers, to:
- provide, operate and run features, characters, events and other content in the Products;
- create, test and balance game content and the game economy;
- moderate names, chat and other content, and help review reports;
- detect and investigate cheating, fraud, abuse and security issues;
- help answer support requests;
- analyze and improve the Products; and
- develop new features and games.
AI service providers process this information for us, under contracts with us. We do not allow AI service providers to use your information to train their own general-purpose models.
AI output. Content produced with AI may be inaccurate, incomplete, inappropriate or unexpected. It is not a statement or promise by PerBlue.
Review of automated decisions. If an automated or AI-assisted decision restricts your account and you appeal under Section 14, a person will review the appeal.
Your consent. By using the Products, you consent to the processing described in this Section.
(E) WE ARE NOT RESPONSIBLE FOR ANY SUBMISSIONS OR OTHER USER CONTENT#
A Submission is the sole responsibility of the user who originated it, and each user is responsible for their own conduct, and for anything done through their account, while using our Products. PerBlue does not take any responsibility, and assumes no liability, for monitoring our Products for any inappropriate or illegal Submissions or other conduct of users made available through our Products. That includes chat functions, direct messages, names, the map, or elsewhere in our Products.
We do not endorse, support, represent, warrant, guarantee or verify the appropriateness or legality of any Submissions or any other conduct of users of our Products. You understand that by using our Products, you may be exposed to Submissions or other user conduct that might be offensive, harmful, inaccurate or otherwise inappropriate. In some cases, Submissions may be mislabeled, deceptive or otherwise unsuited to your purpose.
While we are not obligated to do so, we reserve the right, and have absolute discretion, to:
- review your Submissions and other conduct to determine whether you are complying with these Terms and our policies;
- edit, rename, refuse to post, hide or remove Submissions at any time and for any reason that we believe violates these Terms or our policies; and
- in any chat function, moderate any interactions and mute, restrict or remove any participants, including you, at any time and for any reason that we believe violates these Terms or our policies.
However, under no circumstances will we take any responsibility for the Submissions or other conduct of users of our Products made available through our Products.
5. Restrictions and Limitations Regarding Your Use#
(A) OUR PRODUCTS ARE EVOLVING; BETA AND EARLY ACCESS#
Our Products, including the Materials, are evolving and may change from time to time without prior notice to you. We reserve the right to modify, suspend or discontinue our Products, including any Materials, or any features or parts of them, without prior notice. You agree that we will not be liable for any such modification, suspension or discontinuance.
Parallel Kingdom 2 is in beta. Parts of the Products are unfinished, experimental, or offered as tests, alphas, betas, playtests or previews ("Early Access"). In Early Access:
- features may not work;
- data, progress, characters, plots, Virtual Items and Virtual Currency may be lost or reset; and
- we change game balance often, sometimes while you play.
Unless we say otherwise in writing, we may wipe or reset all or part of the world, including at the end of a test or before public launch. If we ask you to keep information about Early Access features confidential, you agree to do so.
(B) YOUR RESPONSIBILITY FOR YOUR INTERACTIONS#
You are solely responsible for your interactions with other users of our Products, including any disputes. That remains so even if we permit you to report users, block users or use similar features. You must exercise caution, discretion, common sense and judgment in using our Products and in disclosing your personal information to other users.
You agree to take reasonable precautions in all interactions with other users, particularly if you decide to meet a user offline or in person. Parallel Kingdom 2 never requires you to meet another player, or to go anywhere in real life. Other players may use automated tools as permitted by Section 5(E), and you may not always know whether a person is acting directly.
Your use of our Products is at your sole risk and discretion, and we disclaim any and all liability to you or any third party relating to it. We reserve the right to contact you, in compliance with applicable law, in order to evaluate compliance with these Terms. You agree to cooperate fully with PerBlue to investigate any suspected unlawful, fraudulent or improper activity.
(C) PROHIBITED SUBMISSIONS#
In addition to the other restrictions outlined in these Terms, including the Community Rules, you will not create, display, post, publish, share, submit or transmit any Submission through our Products that:
- is sexually explicit, suggestive, revealing or pornographic;
- creates a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to yourself, to any other person, or to any animal;
- may create a risk of any other loss or damage to any person or property;
- seeks to harm or exploit children, or sexualizes minors in any way;
- violates, or encourages any conduct that violates, applicable laws, rules or regulations;
- contains any information or content we deem to be toxic, hateful, violent, harmful, bullying, abusive, discriminatory, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane or otherwise objectionable;
- contains any information that reveals personal information about another individual, or that may be used to track, contact, locate or impersonate that individual. This includes another person's real name, home or work address, real-world location or routine, phone number, e-mail address, or credit card number. It also includes any statement that a character's in-game location is where a real person lives or is;
- disparages, tarnishes or otherwise harms the Product and/or PerBlue, including its owners, affiliates and employees, in PerBlue's opinion;
- contains any information or content that is illegal (including, without limitation, the disclosure of insider information under securities law or of another party's trade secrets);
- infringes, misappropriates or violates any third party's intellectual property, privacy, publicity, or other personal or proprietary rights;

- contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships, or is fraudulent, false, misleading or deceptive.
(D) PROHIBITED ACTIVITIES#
In addition to the other restrictions outlined in these Terms, you will not do any of the following while using our Products:
- create an account for anyone other than yourself, create accounts by automated means, or create an account if we have previously banned you;

- engage in any Unauthorized Transactions (Section 6). This includes any buying, selling, trading or wagering of Virtual Currency, Virtual Items, characters or accounts for real money or anything else outside the game, and any trade between players outside the trade post or other in-game features we provide for that purpose;
- collect or store any personally identifiable information of our users, including information about their characters' positions or land, from our Products without the express written permission of such users, except as needed to play through the API as permitted in Section 5(E);

- (i) sending any unsolicited or unauthorized advertising, spam, solicitations or promotional materials;
- (ii) sending altered, deceptive or false source-identifying information;
- (iii) scripting the creation of Submissions, messages, trades or other requests in such a manner as to interfere with or create an undue burden on our Products, or exceeding rate limits;
- (iv) transmitting software viruses or other harmful or deleterious computer code, files or programs such as trojan horses, worms, time bombs or cancelbots; or
- (v) abusing or exploiting a bug, glitch or similar issue in our Products, instead of reporting it to us;

This includes driving the game's app or website with injected or simulated input, or reading data from its screens;

- distribute, frame, republish, scrape, post, transmit, stream, broadcast, transfer, license, sublicense, publicly display, publicly perform, sell or otherwise exploit in any form or by any means, in whole or in part, any of our Products. This includes:
- scraping user locations, land or power levels; and
- using any non-public information about game play or other users, or any bulk collection of public information about other users, and migrating that data anywhere;
Streaming and videos under our fan content guidelines are allowed.
- remove or modify any trademarks, trade names, trade dress, logos, service marks, map data attributions, or copyright or other proprietary notices in or on our Products, or add any other markings or notices in or on our Products;

- attempt to obtain, obtain or encourage others to obtain any refund with respect to our Products that is based on false, fabricated or fraudulent reasons, make improper use of PerBlue's support services, or submit false reports of abuse or misconduct; or
- use any content or data from the Products to develop, create, train, test, fine-tune, prompt, benchmark or validate any machine learning or artificial intelligence tools, models, systems, algorithms, products or other technologies, except that you may use AI or automation to play your own characters to the extent Section 5(E) permits.
A violation of this Section 5 may result in:
- the removal of your content from our Products;
- the reversal of gains obtained through the violation; and/or
- the suspension or cancellation of your account or of your right and ability to use our Products.
You acknowledge and agree that PerBlue may, in its sole discretion, remove any Submissions, block access to our Products or the content therein, and suspend or terminate any account at any time, for any reason or no reason. To report abuse of these Terms, use the in-game report tools or contact us at [email protected].
(E) THE API#
Parallel Kingdom 2 may offer an application programming interface ("API") that lets you query and act in the game. If we do:
- The API is part of the Products. Everyone who uses the API must comply with these Terms, including the Community Rules. Your account is responsible for everything done through API access issued for it.
- Permitted use. You may use the API, and technology including AI and automation, only as we permit in these Terms and in any API documentation, rules or limits we publish, including rate limits and permissions. Any other automated access to the Products is prohibited (Section 5(D)).
- Your own account. Unless we agree in writing, you may use the API only for your own account and characters, and not to play, run or provide services for anyone else's account.
- Other players' information. Information about other players that you obtain through the API may be used only to play the game. It must not be published, sold, combined with other data to identify or locate real people, or used to train AI models.
- Our control. We may limit, change, suspend or revoke API access, including any API credentials, for anyone at any time, and we may change or stop the API at any time, with or without notice.
6. Virtual Items and Virtual Currency#
Our Products include fictional currencies and items that can be used only within our Products:
- the currencies ("Virtual Currency"), including Food, Gold and Roc Feathers; and
- the items ("Virtual Items"), including goods, resources, equipment, buildings, plots and other land holdings, heroes, soul stones, summon tickets, crates, hats, cosmetics and membership perks.
Virtual Currency may be used to gain limited rights to use Virtual Items. These names and lists may change.
"Food" is a game currency. It is not food, groceries or anything you can eat or redeem outside the game. The same is true of every other Virtual Item named after a real-world thing.
If you acquire limited licenses to use Virtual Currency and Virtual Items, you agree to the following, whether you acquire them from PerBlue, through play, from promotions, or from other players through the trade post:
- they are provided solely for your own personal, non-commercial entertainment use;
- they can only be used with our Products; and
- they are not redeemable for any sum of money or monetary value from PerBlue or any other person or entity at any time.
By acquiring Virtual Currency or Virtual Items, you receive a non-exclusive, non-sublicensable, revocable, limited license to use the Virtual Currency and/or the Virtual Items, as applicable, as part of your use of our Products for your own personal, non-commercial entertainment use. The license is non-transferable, except as allowed in this Section. You agree that you do not have any right, title or interest in and to the Virtual Currency and the Virtual Items, except for the express license rights set forth in this Section. Holding a plot or other place in the game gives you no right of any kind in the real-world place it represents.
THE VIRTUAL CURRENCY AND THE VIRTUAL ITEMS DO NOT HAVE ANY CASH VALUE. NEITHER PERBLUE NOR ANY OTHER PERSON OR ENTITY HAS ANY OBLIGATION TO EXCHANGE YOUR VIRTUAL CURRENCY OR VIRTUAL ITEMS FOR ANYTHING OF VALUE, INCLUDING WITHOUT LIMITATION NEGOTIABLE CURRENCY. IF YOUR ACCESS TO OUR PRODUCTS AND/OR YOUR ACCOUNT IS TERMINATED, WHETHER VOLUNTARILY OR INVOLUNTARILY, YOUR VIRTUAL CURRENCY AND VIRTUAL ITEMS WILL HAVE NO VALUE.
THE PRICES AND VALUE OF VIRTUAL ITEMS, INCLUDING PRICES ON THE TRADE POST, MAY FLUCTUATE SIGNIFICANTLY AND MAY EVEN GO TO ZERO. VIRTUAL ITEMS CANNOT BE USED TO DISCHARGE PAYMENT OBLIGATIONS, ARE NOT FINANCIAL PRODUCTS OR INVESTMENT PRODUCTS, AND SHOULD NOT BE USED FOR FINANCIAL, SPECULATIVE OR INVESTMENT PURPOSES. YOU ACKNOWLEDGE THAT YOU FULLY UNDERSTAND THE RISKS ASSOCIATED WITH ACQUIRING AND TRADING VIRTUAL ITEMS. WE WILL NOT PROVIDE ANY SUPPORT OR ADVICE WHATSOEVER CONCERNING THE VALUE AND/OR LIQUIDITY OF VIRTUAL ITEMS. YOU AGREE TO ASSUME ALL RISK ASSOCIATED WITH THE USE AND VALUE OF THE VIRTUAL ITEMS.
Any balance of Virtual Currency or Virtual Items does not reflect any stored value. The use of Virtual Currency or Virtual Items within our Products may be limited as described in the applicable Other Governing Agreement or in the game. We reserve the right to control, regulate, change, remove, expire, limit or modify any Virtual Currency or Virtual Items at any time without any liability to you. If your account is canceled for any or no reason, you may forfeit any pending, current or future Virtual Currency and Virtual Items, and any other forms of unredeemed value in or associated with your account, without prior notice to you.
Rebalancing and resets. We have the sole right to manage, modify and/or terminate the Virtual Currency and Virtual Items, and we will have no liability to you or anyone else for the exercise of such rights. Parallel Kingdom 2's economy is tuned continually. We may, at any time and without liability:
- change what things cost, produce, drop or pay;
- change tax and fee rates, caps, timers and odds;
- change how Food, Gold and Roc Feathers are earned and spent;
- add or remove ways to earn and spend them;
- reverse transactions that resulted from bugs, exploits or fraud; and
- during Early Access, reset balances, items and the world (Section 5(A)).
We have the sole right to make all calculations regarding your balance of Virtual Currency, including the amount of Virtual Currency that is credited and debited in connection with your use of our Products. While we strive to make such calculations on a consistent and reasonable basis, you agree that our determination of the amount of your Virtual Currency balance is final and binding, absent manifest fraud or error.
Your characters and your account. Your account and its characters may each hold Virtual Currency and Virtual Items. You may move some of them between your account and your own characters, as the game allows. Some Virtual Items are "bound" and cannot be moved, sold or traded. Retiring a character may return some of its holdings to your account, as the game describes.
The trade post. We may provide in-game features that let players trade Virtual Items and Virtual Currency with each other, such as the trade post ("Authorized Trading"). Authorized Trading:
- is subject to the rules, prices, taxes and fees shown in the game, which may change (a seller currently pays a sales tax on each sale, which is removed from the game);
- is final once completed, except that we may reverse trades that resulted from bugs, exploits, fraud, Unauthorized Transactions or violations of these Terms;
- may show your character's name to other players as buyer or seller, unless the game lets you trade anonymously; and
- is a game feature, not a marketplace operated for you. PerBlue is not a party to trades between players and does not guarantee any trade, price or counterparty.
Unauthorized Transactions. Any exchange, trade, transfer, purchase or sale of any Virtual Currency, Virtual Items, characters or accounts other than through Authorized Trading or other features we provide ("Unauthorized Transactions") is strictly prohibited. This includes any exchange for real money or anything else of value outside the game, and any exchange with anyone, including other users of our Products. You acknowledge that PerBlue may terminate or reverse any Unauthorized Transaction, and may remove the Virtual Currency or Virtual Items involved from any accounts that took part. PerBlue may also suspend or terminate your use of our Products if you engage or assist in any Unauthorized Transaction.
You acknowledge and agree that PerBlue will have no liability for the loss of Virtual Currency and/or Virtual Items due to any unauthorized third-party activity. Examples are hacking, phishing, password mining, social engineering, misuse of your API credentials or sign-in links, and/or any other unauthorized third party's or other user's activity, including any Unauthorized Transactions. PerBlue may replace such lost Virtual Currency and/or Virtual Items under certain circumstances, at its sole discretion on a case-by-case basis, without incurring any obligation or liability to you or any other user of our Products.
Random rewards. Some features give Virtual Items at random, for example hero summons, crates and loot. Where a random feature can be paid for with Virtual Currency that can be bought with money, we show the odds before you use it. Odds may change, and we will show the current odds.
We may revise the pricing for Virtual Currency and Virtual Items offered through our Products at any time. We may limit the total amount of Virtual Currency or Virtual Items that may be purchased or earned at any one time, and/or the total amount that may be held in your account in the aggregate. We may also impose a maximum balance of Virtual Currency acquirable with United States Dollars or other applicable currency that you can maintain with PerBlue at any given time.
You are only allowed to obtain Virtual Currency and Virtual Items from us or our authorized partners, through play, or through Authorized Trading, and not in any other way.
7. Orders and Payments#
What we sell. When payments are available, PerBlue may sell Food, in packs, and memberships that give perks for a period, such as daily Food and Roc Feathers, a weekly crate and member cosmetics. Money buys Food and memberships; other Virtual Items are bought with Virtual Currency in the game. Payments are not yet offered. Any store shown during Early Access is a test, and no card is charged.
A) PAYMENT
You agree to pay all fees and charges, including applicable taxes, incurred by you or through the use of your Registration Data, your API access and/or the account registered to you. Unless otherwise indicated, all prices are in United States Dollars. If a price is in United States Dollars and you are using a local currency, the actual amount charged to you may fluctuate based on currency exchange rates without notice to you. You represent to us that you are an authorized user of the chosen method of payment used to pay any fees or charges incurred plus all applicable taxes.
YOU AGREE THAT YOU ARE FULLY LIABLE AND RESPONSIBLE FOR ALL FEES AND CHARGES MADE THROUGH YOUR REGISTRATION DATA, YOUR API ACCESS AND/OR YOUR ACCOUNT VIA THE PRODUCTS. YOU AGREE THAT ALL SALES ARE FINAL, EXCEPT AS SET FORTH IN THIS SECTION OR REQUIRED BY LAW.
B) PRICING CHANGES
PerBlue may revise the pricing for the Products and their components at any time. If PerBlue makes a change to the subscription price for a Product, the change will not apply to you until your current Subscription Service expires or is renewed, whichever is earlier.
Where prices increase for Subscription Services, we will notify you of the relevant fee increase before your Subscription Service renews. After that, your use of the applicable Products will be charged at the then-current prices.
If you do not agree to these price changes, you must cancel your Subscription Services before the changes take effect, through the processes set forth in Section 7(C). If you do not cancel, your Subscription Services will automatically renew at the then-current price, for the same duration as the initial subscription term, and we will charge your on-file payment card or method on the first day of the renewed term.
All purchases are final. PerBlue does not offer refunds, except for presale purchases if Parallel Kingdom 2 never launches (Section 7(C)) and as required by law.
C) ADDITIONAL SUBSCRIPTION TERMS
PerBlue may offer one or more of its Products on a recurring basis, including memberships ("Subscription Services"). If you purchase Subscription Services:
- you are requesting that PerBlue begin supplying them immediately;
- you are entering into a subscription contract with PerBlue, which may be monthly or for some other period you agree to; and
- you are authorizing a charge in the amount of the subscription fee, at the rate quoted at the time of purchase.
For Subscription Services purchased through a platform such as Apple or Google, the platform will charge you the subscription fee and the platform's payment terms will apply. Please review that platform's payment terms for more information.
IF YOU ENTER INTO A SUBSCRIPTION SERVICE, UNLESS YOU CANCEL IT BEFORE RENEWAL, BY DEFAULT (AND WITH PRIOR NOTICE TO THE EXTENT REQUIRED BY APPLICABLE LAW) YOUR SUBSCRIPTION SERVICE WILL AUTOMATICALLY RENEW FOR THE AGREED MONTHLY OR ANNUAL TERM, AND THE APPLICABLE SUBSCRIPTION FEE WILL BE AUTOMATICALLY CHARGED TO YOU AT THE TIME OF RENEWAL USING THE ACTIVE PAYMENT METHOD ON FILE IN YOUR ACCOUNT.
IF YOU DO NOT WANT YOUR SUBSCRIPTION SERVICE TO AUTOMATICALLY RENEW, YOU CAN CANCEL IT AT ANY TIME BEFORE RENEWAL:
- IN YOUR ACCOUNT SETTINGS IN THE PRODUCTS;
- VIA GOOGLE PLAY OR THE APPLE APP STORE, IF YOU SUBSCRIBED THERE; OR
- BY CONTACTING US AT [email protected].
Cancellation takes effect at the end of the current period, and your perks continue until then. You may also pause a membership. While it is paused, you are not billed and receive no perks.
If we offer Subscription Services to residents of the European Union or the United Kingdom, those residents have a statutory right to cancel them at any time within fourteen (14) days from the date of purchase. You may then obtain a refund of your initial payment, minus a reasonable prorated portion to cover your use of the Product subscription before cancellation. Please review the appropriate platform's cancellation terms for more information.
We reserve the right to suspend, disable, cancel or terminate your subscription, or to convert your subscription account to a standard account, at our discretion and without any notice. If we cancel your subscription, it will not renew and you will not be charged again. Any refund for the current period will be given only as required by law, and none will be given if we terminate your account or your subscription because we determine, in our sole discretion, that your actions or your use of the Products violate these Terms or have harmed another user.
We reserve the right to charge fees for the right to use Virtual Currency or Virtual Items, and/or to distribute Virtual Currency or Virtual Items without charge, in our sole discretion. You agree that we may take any action that affects the perceived value of, or pricing for, any Virtual Currency, Virtual Items and/or any of our Products at any time.
You may purchase limited licenses to use Virtual Currency and Virtual Items from PerBlue in accordance with these Terms. You agree that all such purchases are final and non-cancellable, except as set forth in this Section. If you order licenses for Virtual Currency or Virtual Items that become unavailable before they can be provided to you, your only remedy is to request a refund of the purchase price from the payment processor of the transaction.
You expressly consent to the making available of Virtual Currency and/or Virtual Items immediately upon acceptance of your order. If we offer the Products to residents of the European Union or the United Kingdom and such a resident purchases limited licenses to Virtual Currency or Virtual Items from us, the right to withdraw from such purchases within fourteen (14) days from the date of purchase ("Cooling Off Period") may be available to you. However, this right of withdrawal does not apply where our performance begins before the end of the Cooling Off Period. Therefore, you expressly agree that if you order limited licenses to Virtual Currency or Virtual Items from us, your right of withdrawal is forfeited upon your acceptance, because performance begins immediately on your acceptance.
Presale and pending Food. If we sell Food before Parallel Kingdom 2 opens to the public (a "presale"), that Food is held for your account as a pending entitlement and becomes usable when the game opens. If Parallel Kingdom 2 never launches, presale purchases will be refunded or credited, as described in the presale's own terms, which also govern delivery, any bonus Food and the date by which the game must open. This is the only refund PerBlue offers, apart from refunds required by law. Buying Food is a purchase of a game license, not an investment, donation or loan. It gives no ownership, equity, revenue share or return.
D) THIRD-PARTY PAYMENT PROCESSORS
You may be required to give the applicable payment processor or platform your credit or debit card number or other payment information, and related billing information. This may happen in connection with your use of the Products, your purchase of Product subscriptions, and/or your purchase of Virtual Currency or Virtual Items. PerBlue does not receive or store full card numbers.
We are not responsible or liable to you for any card or bank-related charges and fees related to your transactions on our Products. All such transactions are administered by a third-party payment processor. PerBlue expressly disclaims any liability for any such transactions. Except for presale refunds under Section 7(C), you agree that your sole avenue of recourse regarding such transactions is through the third-party payment processor.
E) CANCELLATION AND REFUNDS
ALL PURCHASES WITH RESPECT TO THE PRODUCTS ARE FINAL AND NON-CANCELLABLE, AND UNDER NO CIRCUMSTANCES WILL BE REFUNDABLE, TRANSFERABLE OR EXCHANGEABLE. PERBLUE HAS NO REFUND POLICY. THE ONLY EXCEPTIONS ARE:
- PRESALE PURCHASES, WHICH WILL BE REFUNDED OR CREDITED IF PARALLEL KINGDOM 2 NEVER LAUNCHES (SECTION 7(C));
- PURCHASES MADE THROUGH THE APPLE APP STORE OR GOOGLE PLAY, WHOSE REFUNDS ARE DECIDED BY APPLE OR GOOGLE UNDER THEIR OWN POLICIES (SECTION 7(F));
- STATUTORY CANCELLATION OR WITHDRAWAL RIGHTS, SUCH AS THOSE OF EU AND UK CONSUMERS DESCRIBED ABOVE, WHERE THEY APPLY; AND
- ANY OTHER REFUND REQUIRED BY APPLICABLE LAW.
Virtual Currency may be exchanged for Virtual Items in the game; that is not a refund.
You agree to pay all fees or charges incurred by you, including applicable taxes, at the time the applicable fee or charge becomes payable. You agree not to otherwise dispute or charge back any payments for purchases that have been successfully credited to your account within the Products, or otherwise attempt to defraud PerBlue.
If PerBlue receives notice of a payment dispute or chargeback for a successfully completed purchase that has already been credited to your account, your account may be indefinitely suspended or terminated, and we may remove the Virtual Currency or Virtual Items from that purchase.
F) IN-APP PURCHASES
When you make purchases through the Apple App Store or Google Play, you agree to their respective terms and conditions (http://www.apple.com/legal/internet-services/itunes/us/terms.html; http://play.google.com/intl/en_us/about/play-terms.html). If you are unsure about your rights in purchases made through either service, check with that service before making a purchase. All payment-related requests about such purchases should be directed to Apple or Google through their respective service, and are subject to their respective terms and conditions.
We are not a party to any In-App Purchases, and we have no obligation to, and cannot, provide refunds or credits for them, except as required by law. All sales of Virtual Currency and Virtual Items are final, and charges paid by you are final and non-refundable, except as required by law or otherwise set forth in these Terms.
8. Bonuses, Promotions, and Referral Rewards#
Our Products may offer one-time or limited-time loot, bonuses, grants or other benefits ("Benefits"). Examples are:
- Food, Roc Feathers, Gold or items for creating an account, verifying your email address, completing first steps, or checking in;
- member perks;
- event rewards and codes; and
- rewards for referring others, or for your standing in a contest.
Benefits must be used by and for the intended audience and purposes. They may not be sold or transferred in any manner, or made available to the general public (whether posted to a public forum or otherwise), unless PerBlue expressly permits it. Except as permitted by PerBlue, Benefits are non-transferable, may not be resold, and are not redeemable for cash or other consideration. Benefits that become Virtual Currency or Virtual Items are subject to Section 6.
You agree we may change the terms and conditions governing the Benefits, terminate any Benefits program, or expire, deduct, limit or modify your Benefits at any time for any reason. That includes where PerBlue determines or believes that your participation in a Benefits program, or your use or redemption of Benefits, was in error, fraudulent, illegal, made through more than one account, or otherwise in violation of these Terms.
Contests and referral programs. Contests, referral programs and leaderboard rewards are governed by the Promotions and Referral Program Official Rules in Appendix B, including the schedule for each promotion. Referral rewards are granted as in-game Food credit, not cash. Free promotional Food and credits have no cash value, and are cancelled if Parallel Kingdom 2 does not launch.
In the event of abuse of any Benefits program by any user, PerBlue reserves the right to retract your Benefits and any Virtual Items obtained with them.
9. Third-Party Links, Sites and Products; Map Data#
(A) THIRD-PARTY MATERIALS#
Our Products rely on or interoperate with third-party products and services, including, without limitation, hosting and data storage services, email delivery, map tiles and map data, AI services, communications technologies, third-party app stores, and internet and mobile operators (collectively, "Third-Party Materials"). These Third-Party Materials are beyond our control, but their operation may affect, or be affected by, the use and reliability of our Products. You acknowledge that:
- (a) the use and availability of the Products depends on third-party product vendors and service providers; and
- (b) these Third-Party Materials may not operate reliably 100% of the time, which may affect the way our Products operate.
Specifically, certain items of independent, third-party code may be used in connection with the Products that may be subject to open-source licenses ("Open-Source Software"). The Open-Source Software is licensed to us under the terms of the license that accompanies it, and may be licensed to you under the terms of the same license or through other terms. Nothing in the Terms limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable license for such Open-Source Software.
We may further provide information about or links to third-party products, services, activities or events, or we may allow third parties to make their content and information available on or through our Products (collectively, "Third-Party Content"). We provide Third-Party Content as a service to those interested in such content. Your dealings or correspondence with third parties, and your use of or interaction with any Third-Party Content, are solely between you and the third party.
We have no obligation to monitor Third-Party Materials or Third-Party Content, and we may block or disable access to any Third-Party Materials or Third-Party Content (in whole or part) through our Products at any time. Your access to and use of such Third-Party Content or Third-Party Materials may be subject to additional terms, conditions and policies, including the terms of service or privacy policies of their providers. You are responsible for obtaining and maintaining any computer hardware, equipment, network services and connectivity, telecommunications services, and other products and services necessary to access and use the Products.
(B) MAP DATA AND REAL PLACES#
Parallel Kingdom 2's world is drawn on a map of the real world. Map data comes from third parties, including:
- OpenStreetMap: © OpenStreetMap contributors, available under the Open Database License (ODbL) 1.0 (openstreetmap.org/copyright);
- OpenMapTiles and OpenFreeMap: map styles and tiles; and
- Overture Maps Foundation: © Overture Maps Foundation and its data sources, under the licenses listed at docs.overturemaps.org/attribution.
These providers keep their rights in their data. Our use of it is subject to their licenses, and attributions shown in the Products must not be removed or hidden. omit any promise about publishing the derived map database until counsel decides whether the ODbL share-alike applies.
Map data may be wrong, out of date or incomplete, and the game changes and adds to it. Places, roads, buildings, boundaries, parks and points of interest in the game:
- are not a guide to the real world. Do not rely on the game for navigation or safety, or to tell whether a place is open, public, safe or lawful to visit;
- are not endorsements. A place appearing in the game, or being a plot, lair, town or other game feature, does not mean its owner or occupant sponsors, endorses or is affiliated with Parallel Kingdom 2 or PerBlue; and
- give no real-world rights. Claiming, holding, naming, building on or attacking a place in the game gives no right to enter, use or do anything at the real place, and does not affect anyone's real property.
If you own or manage a real-world place and want it changed or removed from the game, contact us at [email protected], subject "Place request". We will review requests within 15 business days and may remove or change how the place appears.
10. Security#
We care about the security of our users. PerBlue, however, cannot guarantee that unauthorized third parties will not be able to access your account.
You sign in with links we send to your email, so the security of your email account is the security of your Parallel Kingdom 2 account. Use a strong, unique password and two-factor authentication for your email. Never forward a sign-in link or share a sign-in code. Keep any API credentials secret, and revoke any you no longer use or think may be exposed. You can review your active sessions in your account settings.
You agree that you will not share your sign-in links or API credentials with others, and that you will not do anything that might jeopardize the security of your account. You accept all responsibility for any activity that occurs with respect to your account, whether or not you are aware of it. Please notify us immediately at [email protected] of any unauthorized use of your account.
11. Location-Based Services, Push Notifications, and Other Communications#
(A) HOW LOCATION WORKS IN PARALLEL KINGDOM 2#
Parallel Kingdom 2 uses a map of the real world as its game board ("Location-Based Services"). Here is how location works:
- Your characters' locations are virtual. Every character has a position on the game map. That position is the character's location in the game. You set it by choosing where to start and where to travel, and it changes as the character travels in the game.
- It may or may not be where you are. A character's location may match your physical location at some moments, for example if you start or travel to where you are. It does not have to. We do not guarantee that any character's location matches, or does not match, the physical location of any person, and you should not assume either. Nothing in the game requires you to be, or go, anywhere in real life.
- Device location is optional. The Products may offer features that use your Device's location, for example to show where you are on the map or to start or travel there. These features work only if you allow them in your browser or Device, and you can turn them off at any time. Device location can be inaccurate. We make no guarantee about the accuracy of any location in the Products.
- Locations are public in the game world. Character locations are public within the game world. There is no anonymous, hidden or private mode: whatever you do in the geo-located world, including where your characters are and travel, the land they hold, and what they build, fight and claim there, is visible to other players. In particular, other players can see:
- your characters' in-game positions and travel on the map;
- the land (plots) your characters hold and where it is, including on your public profile;
- roughly how far away your characters are; and
- the region your character is in, through regional chat.
If you do not want others to associate a real place with you, such as your home, school or workplace, do not move your characters there and do not claim land there.
Should you use Location-Based Services, you consent to our collection, use and display of location information through our Products as described in these Terms and our Privacy Policy, including showing your characters' in-game locations and land to other players. Under no circumstances will we be liable for claims or damages arising out of your informed decision to disseminate your location information through our Products.
(B) STAY SAFE IN THE REAL WORLD#
Parallel Kingdom 2 is a game played on a screen. When you play:
- Never play while driving or operating any vehicle, bicycle or machinery. Do not use the game in any situation where it could distract you and lead to death, injury or property damage.
- Be aware of your surroundings. Stop moving before you interact with the game, and watch for traffic and hazards.
- Do not trespass. Do not enter or remain on private property, restricted areas, construction sites, rail lines, water, cliffs, or anywhere unsafe or closed to the public because of anything in the game.
- Obey the law and the rules of the places you visit, including parks, schools, places of worship, memorials, workplaces and private businesses. Respect people's privacy and property.
- Do not go to meet players you only know from the game. If you choose to, meet in a public place, tell someone you trust, and remember that people may not be who they say they are.
YOU AGREE THAT YOUR USE OF LOCATION-BASED SERVICES, AND ANY REAL-WORLD ACTIVITY CONNECTED WITH THE GAME, IS AT YOUR SOLE RISK.
(C) PUSH NOTIFICATIONS AND EMAIL#
The Products may send push or browser notifications to Devices that support them. 14. Suspension; Termination; Deleting Your Account#
You may terminate your account or discontinue your use of our Products at any time for any reason. To delete your account, use "Delete account" in your account settings (to be built), or email [email protected], subject "Delete my account", from the address on your account. We will confirm the request by email before deleting. Deletion is permanent and cannot be undone. It removes all of your characters, and you will lose all Virtual Currency, Virtual Items, memberships, names and progress. Our Privacy Policy explains what we delete, what we keep, and for how long.
If you stop using our Products, with or without terminating your account, your account may be terminated due to prolonged inactivity as determined by PerBlue. We may also release names and land held by inactive accounts, as described in the game.
We may suspend, restrict or terminate your use of our Products at any time for any reason. Restricting includes, for example, muting chat, removing a name, or limiting trading or API access. Reasons include, but are not limited to, a reasonable belief that:
- (a) you, or anything acting through your account, have violated these Terms;
- (b) you create risk or possible legal exposure for us or any of our users; or
- (c) our provision of our Products to you is no longer commercially viable.
We will make reasonable efforts to notify you at the e-mail address you provide to us, or the next time you attempt to use our Products. If you believe we made a mistake, you may appeal by emailing [email protected], subject "Appeal", within 30 days. A person will review the appeal.
Upon termination of your account for any reason, any Virtual Currency and/or Virtual Items to which you had access immediately before termination will be lost and will no longer be available to you, and you will have no right to them. PERBLUE IS NOT REQUIRED TO PROVIDE A REFUND TO YOU FOR ANY VIRTUAL CURRENCY OR VIRTUAL ITEMS FOR ANY REASON, AND YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL CURRENCY AND/OR VIRTUAL ITEMS UPON TERMINATION FOR ANY REASON, EXCEPT FOR PRESALE REFUNDS UNDER SECTION 7(C) OR AS REQUIRED BY LAW.
Upon termination of your account for any reason, we will have no obligation to provide any of our Products to you, and your limited license to use our Products as set forth in these Terms will terminate. We will not be liable to you or any third party for termination of our Products or of your use of our Products.
UPON ANY TERMINATION, ANY SUBMISSIONS THAT YOU HAVE SUBMITTED IN OUR PRODUCTS, OR THAT ARE RELATED TO YOU, MAY NO LONGER BE ACCESSED BY YOU. WE, IN OUR SOLE DISCRETION AND SUBJECT TO OUR PRIVACY POLICY, MAY SHARE SUCH SUBMISSIONS IN ACCORDANCE WITH THESE TERMS INDEFINITELY, OR DESTROY ALL OR PART OF THEM, WITHOUT ANY LIABILITY OR OBLIGATION TO YOU. Furthermore, we will have no obligation to maintain any information stored in our database related to you or to forward any such information to you.
If we shut down Parallel Kingdom 2. If we decide to permanently shut down Parallel Kingdom 2, we will give at least 30 days' notice in the game and by email, and we will stop selling Virtual Currency and memberships when we give that notice. No refunds are given for unused Virtual Currency, Virtual Items or membership time, except presale refunds under Section 7(C) and as required by law.
Sections 2, 4, 5, 6 (as to the absence of value and our rights), 12 through 19, and Appendices A and B (as to completed promotions) of these Terms will survive termination of your account.
15. Indemnity#
You agree to indemnify, defend and hold harmless PerBlue and its directors, officers, employees and agents from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including reasonable legal and accounting fees (including costs of defense of claims, suits or proceedings brought by third parties), in any way related to:
- (a) your use of our Products, including through the API or automated tools;
- (b) your Submissions or Feedback;
- (c) your breach or violation of any of these Terms;
- (d) your violation, misappropriation or infringement of the rights of other users or third parties, including intellectual property rights, privacy rights, and property rights such as trespass;
- (e) your use of the Products to meet another user in person, or to locate, visit or enter any physical place; or
- (f) your conduct in connection with the Products.
You agree to promptly notify PerBlue of any third-party claims. PerBlue reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you. In that case, you agree to cooperate with PerBlue in the defense of the matter.
Notwithstanding the foregoing paragraph, if you are a resident of New Jersey, you only agree to release, defend, indemnify and hold harmless PerBlue and each of its officers, directors, employees, shareholders and representatives from and against any third-party claims, liabilities, damages, losses and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your violation of these Terms.
IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH PROVIDES: A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
If you are not a California resident, you waive your rights under any statute or common law principle similar to California Civil Code Section 1542 that governs your rights in the jurisdiction of your residence.
16. Limitations of Liability#
YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE PRODUCTS. IN NO EVENT WILL PERBLUE OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY TYPE OR KIND (INCLUDING ANY ALTERATION, BREACH, COMPROMISE, CORRUPTION OR LOSS OF DATA) IN ANY WAY RELATED TO:
- (A) THE USE OF OUR PRODUCTS;
- (B) THE PROVISION OF OUR PRODUCTS;
- (C) THE CONDUCT OF OTHER USERS OF OUR PRODUCTS;
- (D) THE USE OF ANY THIRD-PARTY CONTENT OR THIRD-PARTY MATERIALS MADE AVAILABLE THROUGH OUR PRODUCTS;
- (E) THESE TERMS OR OUR PRIVACY POLICY; OR
- (F) ANY REAL-WORLD TRAVEL, VISIT OR MEETING IN CONNECTION WITH THE PRODUCTS.
YOUR ONLY REMEDY AGAINST PERBLUE FOR DISSATISFACTION WITH OUR PRODUCTS IS TO STOP USING OUR PRODUCTS.
IF, NOTWITHSTANDING THESE TERMS, PERBLUE IS FOUND LIABLE TO YOU, THE CUMULATIVE LIABILITY OF PERBLUE AND ITS LICENSORS TO YOU WILL IN NO EVENT EXCEED US$100.00, OR, IF GREATER, THE AMOUNT YOU PAID PERBLUE FOR THE PRODUCTS IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
THESE LIMITATIONS WILL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT PERBLUE HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE LIABILITY FOR OUR GROSS NEGLIGENCE, FRAUD OR INTENTIONAL MISCONDUCT, OR FOR ANY OTHER MATTERS IN WHICH LIABILITY CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Some jurisdictions do not allow such limitations of liability, so the foregoing limitations will apply to you up to the maximum extent permitted under applicable law. THE LIMITATION OF LIABILITY DESCRIBED ABOVE WILL APPLY FULLY TO NEW JERSEY RESIDENTS.
17. Arbitration and Class Action Waiver#
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES YOU AND PERBLUE TO ARBITRATE CERTAIN DISPUTES AND CLAIMS AND LIMITS THE MANNER IN WHICH WE CAN SEEK RELIEF FROM EACH OTHER. ARBITRATION PRECLUDES YOU AND PERBLUE FROM SUING IN COURT OR HAVING A JURY TRIAL. EXCEPT AS SET FORTH IN SECTION 17(L), YOU AND PERBLUE AGREE THAT ARBITRATION WILL BE SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ARBITRATION, CLASS ACTION, OR ANY OTHER KIND OF REPRESENTATIVE PROCEEDING. PERBLUE AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY.
THE PARTIES ACKNOWLEDGE THAT THE TERMS OF THIS SECTION ARE INTENDED TO REDUCE THE FINANCIAL BURDENS ASSOCIATED WITH RESOLVING THEIR DISPUTES AND ARE NOT INTENDED TO DELAY ADJUDICATION OF ANY PARTY'S CLAIMS.
FOLLOW THE INSTRUCTIONS BELOW, IN SECTION 17(M), IF YOU WISH TO OPT OUT OF THE REQUIREMENT OF ARBITRATION ON AN INDIVIDUAL BASIS. NO CLASS OR REPRESENTATIVE ACTIONS OR ARBITRATIONS ARE ALLOWED UNDER THIS ARBITRATION AGREEMENT EXCEPT AS SET FORTH IN SECTION 17(L).
A) Claims This Section Applies To
The dispute resolution and binding arbitration terms in this Section 17 apply to all Claims between you and PerBlue. For the purposes of this Section 17, a "Claim" is any dispute, claim or controversy (excluding those exceptions listed below) between you and PerBlue, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, that either party wishes to seek legal recourse for and that arises from or relates to your use of our Products, these Terms or our Privacy Policy. This includes any privacy or data security claims, and claims related to the validity, enforceability or scope of the arbitration requirement or any portion of it.
B) Informal Dispute Resolution Prior to Arbitration
If you have a Claim against PerBlue, or PerBlue has a Claim against you, you and PerBlue will first attempt to resolve the Claim informally, for faster resolution and to reduce costs for both parties.
You and PerBlue will make a good-faith effort to negotiate the resolution of any Claim for a period of sixty (60) days, or such longer period as the parties mutually agree in writing (e-mail suffices) (the "Informal Resolution Period"). The period runs from the day either party receives a written notice of a dispute from the other party (a "Claimant Notice") in accordance with these Terms. The Informal Resolution Period is designed to allow the party who has received a Claimant Notice to make a fair, fact-based offer of settlement if it chooses to do so. The statute of limitations and any filing fee deadlines for a Claim will be tolled for the duration of the Informal Resolution Period for that Claim, so that the parties can engage in this informal dispute-resolution process.
You will send any Claimant Notice to PerBlue by certified mail addressed to PerBlue Entertainment, Inc.; Attn: Claimant Notice; 821 E Washington Ave, Suite 200, Madison, WI 53703 USA, or by e-mail to [email protected]. PerBlue will send any Claimant Notice to you by certified mail or e-mail, using the contact information you have provided to PerBlue. The Claimant Notice sent by either party must:
- (i) include the sender's name, address, e-mail address and telephone number;
- (ii) describe the specific nature and basis of the Claim in detail, outlining specific alleged issues along with supporting evidence; and
- (iii) set forth the specific relief sought.
You or PerBlue can file a Claim in arbitration only after the end of the Informal Resolution Period. You or PerBlue cannot proceed to arbitration before the end of the Informal Resolution Period. If you or PerBlue file a Claim in court or proceed to arbitration without complying with the requirements in Section 17, including waiting until the end of the Informal Resolution Period, the other party reserves the right to:
- seek relief from a court to enjoin the filing; and
- seek damages from the party that has not followed the requirements in this Section, to reimburse it for any arbitration fees and costs already incurred as a foreseeable consequence of that breach.
C) Claims Subject To Binding Arbitration; Exceptions
The following are excepted from arbitration:
- individual disputes that qualify for small claims court (provided that the small-claims court does not permit class or similar representative actions or relief); and
- any disputes exclusively related to the intellectual property or intellectual-property rights of you or PerBlue, including any disputes in which you or PerBlue seek injunctive or other equitable relief for the alleged unlawful use of your or PerBlue's intellectual property, or other infringement of your or PerBlue's intellectual property rights ("IP Claims").
All other Claims that are not resolved in accordance with Section 17(B) will be resolved by a neutral arbitrator through final and binding arbitration, instead of in a court by a judge or jury. This includes Claims that are not related to intellectual property or intellectual-property rights but are jointly filed with IP Claims. Such Claims include, without limitation, disputes arising out of or relating to the interpretation or application of this arbitration provision, including the enforceability, revocability or validity of the arbitration provision or any portion of it. The arbitrator will have the authority to grant any remedy or relief that would otherwise be available in court.
D) Binding Individual Arbitration
Subject to the terms of this Section 17, Claims may only be settled by binding individual arbitration conducted by Judicial Arbitration and Mediation Services ("JAMS", https://www.jamsadr.com/), according to the Federal Arbitration Act, 9 U.S.C. § 1, et seq. (the "FAA"). For Claims arbitrated by JAMS, the then-current version of the Streamlined Arbitration Rules (https://www.jamsadr.com/rules-streamlined-arbitration/) are the rules applicable to Claims between you and PerBlue, as modified by these Terms (the "Rules").
These Terms affect interstate commerce, and the enforceability of this Section 17 will be substantively and procedurally governed by the FAA to the extent permitted by law. As limited by the FAA, these Terms and the Rules, the arbitrator, and not any federal, state or local court or agency, will have exclusive authority to make all procedural and substantive decisions regarding any Claim and to grant any remedy that would otherwise be available in court, including the power to determine the question of arbitrability.
To the fullest extent allowed by applicable law, the arbitrator may only award legal or equitable remedies that are individual to you or PerBlue to satisfy one of our individual Claims, and that the arbitrator determines are supported by credible relevant evidence.
To the extent that you prevail on a Claim and seek public injunctive relief (that is, injunctive relief whose primary purpose and effect is to prohibit and enjoin conduct harmful to the general public), the entitlement to and extent of such relief must be litigated in a civil court of competent jurisdiction and not in arbitration. The parties agree that litigation of any issues of public injunctive relief shall be stayed pending the outcome of the merits of any individual Claims in arbitration.
E) Arbitration Procedure
You or PerBlue may initiate arbitration of any Claim not resolved during the Informal Resolution Period and not excluded under Section 17(C) by filing a demand for arbitration with JAMS in accordance with the Rules.
Instructions for filing a demand with JAMS are available on the JAMS website. You will send a copy of any demand for arbitration to PerBlue by certified mail addressed to PerBlue Entertainment, Inc., Attn: Arbitration Demand, 821 E Washington Ave, Suite 200, Madison, WI 53703 USA, or by e-mail to [email protected]. PerBlue will send any demand for arbitration to you by certified mail or e-mail, using the contact information you have provided to PerBlue.
The arbitration will be conducted by a single arbitrator in the English language. You and PerBlue both agree that the arbitrator will be bound by these Terms.
The arbitrator (not a judge or jury) will resolve all Claims in arbitration. Unless you and PerBlue agree otherwise, any decision or award will include a written statement stating the decision on each Claim and the basis for the award, including the arbitrator's essential factual and legal findings and conclusions.
F) Arbitration Fees
Each party will be responsible for arbitration fees in accordance with the applicable Rules and these Terms.
G) Frivolous or Improper Claims
To the extent permitted by applicable law, a claimant must pay all costs incurred by the defending party, including any attorney's fees, related to a Claim if an arbitrator determines that:
- (i) the Claim was not warranted by existing law or by a nonfrivolous argument; or
- (ii) the Claim was filed in arbitration for any improper purpose, such as to harass the defending party, cause unnecessary delay, or needlessly increase the cost of dispute resolution.
H) One Year to Assert Claims
To the extent permitted by law, any Claim by you or PerBlue against the other must be filed within one (1) year after the Claim arises. Otherwise, the Claim is permanently barred, which means that you or PerBlue will no longer have the right to assert that Claim.
I) Arbitration Venue
For Claims in which the claimant seeks less than USD $10,000, the arbitrator will decide the matter solely based on written submissions, without a formal hearing, unless the arbitrator decides that a formal hearing is necessary.
For Claims in which the claimant seeks USD $10,000 or more, or smaller matters in which the arbitrator determines a hearing to be necessary, hearings will be conducted by video or telephone, unless the arbitrator determines an in-person hearing to be necessary.
If an in-person hearing is required and you reside in the United States, the arbitrator will determine a location for the hearing within the United States that is reasonably convenient for you. For residents outside the United States, any in-person hearings will be held in Dane County, Wisconsin, United States of America.
J) Confidentiality
If you or PerBlue submits a Claim to arbitration, you and PerBlue agree to cooperate to seek from the arbitrator protection for any confidential, proprietary, trade secret or otherwise sensitive information, documents, testimony and other materials that might be exchanged or be the subject of any discovery in the arbitration. You and PerBlue agree to seek such protection before any such information, documents, testimony or materials are exchanged or otherwise become the subject of discovery in the arbitration.
K) Arbitration Award
An arbitration award, and any judgment confirming it, apply only to that specific case. It cannot be used or offered as precedent in any other case except to enforce the award itself, unless the parties agree before the award is issued. Any arbitration decision or award may be enforced as a final judgment by any court of competent jurisdiction or, if applicable, application may be made to such court for judicial confirmation of any award and an order of enforcement.
L) Coordinated Filings
If 75 or more Claimant Notices are received by a party that raise similar claims and have the same or coordinated counsel, these will be considered "Coordinated Claims". They will be treated as mass filings or multiple case filings, and will be subject to a bellwether arbitration process. The JAMS Mass Arbitration Procedures and Guidelines (https://www.jamsadr.com/mass-arbitration-procedures) are the Rules applicable to Coordinated Claims, as modified by these Terms.
You or PerBlue may advise the other of your or PerBlue's belief that Claims are Coordinated Claims. Disputes over whether a Claim meets the definition of "Coordinated Claims" will be decided by the arbitration provider as an administrative matter. To the extent either party is asserting the same Claim as other persons and is represented by common or coordinated counsel, that party waives any objection that the joinder of all such persons is impracticable.
The JAMS Process Administrator (as described in the Rules) will have the authority to implement the procedures set forth in the Rules for Coordinated Claims, including the authority to batch together individual arbitration demands into a single coordinated proceeding.
M) Opting Out of Arbitration
You have the right to opt out and not be bound by the arbitration requirement set forth above, by sending written notice of your decision to opt out to [email protected] with the subject line "ARBITRATION OPT-OUT". To be effective, the opt-out notice must:
- (i) include your full name, mailing address and e-mail address (the one on your Parallel Kingdom 2 account);
- (ii) clearly indicate your intent to opt out of binding arbitration; and
- (iii) be sent within thirty (30) days of your first acceptance of these Terms.
Otherwise, you will be bound to arbitrate disputes in accordance with the terms of this Section.
By opting out of binding arbitration, you are agreeing to resolve disputes in accordance with Section 18. If you opt out of these arbitration provisions, we also will not be bound by them with respect to Claims between you and PerBlue. You may also opt out by mail to PerBlue Entertainment, Inc., Attn: Arbitration Opt-Out, 821 E Washington Ave, Suite 200, Madison, WI 53703.
N) Rejection of Future Arbitration Changes
You may reject any change we make to Section 17 (except address changes) by sending us notice of your rejection to [email protected] with the subject line "ARBITRATION CHANGE REJECTION". To be effective, the rejection notice must:
- (i) include your full name, mailing address and e-mail address;
- (ii) clearly indicate your intent to reject changes that were made to Section 17; and
- (iii) be sent within thirty (30) days of PerBlue providing notice of the updated Terms.
Otherwise, you will be bound to arbitrate disputes in accordance with the updated terms of this Section. Changes to Section 17 may only be rejected as a whole, and you may not reject only certain changes to Section 17. If you reject changes made to Section 17, the most recent version of Section 17 that you have not rejected will continue to apply.
O) Severability
If a court or arbitrator decides that any portion of this Section 17 is unenforceable or unlawful for any reason, including but not limited to because it is found to be unconscionable:
- (i) the unenforceable or unlawful provision will be severed from these Terms;
- (ii) severance of the unenforceable or unlawful provision will have no impact whatsoever on the remainder of this Section 17, or on the parties' ability to compel arbitration of any remaining claims on an individual basis pursuant to this Section 17; and
- (iii) to the extent that any claims must therefore proceed on a class, collective, consolidated or representative basis, such claims must be litigated in a civil court of competent jurisdiction, in accordance with these Terms, and not in arbitration.
The litigation of those claims will be stayed pending the outcome of any individual claims in arbitration. Further, if any part of this Section 17 is found to prohibit an individual claim seeking public injunctive relief, that provision will have no effect to the extent such relief is allowed to be sought out of arbitration, and the remainder of this Section 17 will be enforceable.
18. Governing Law, Jurisdiction and Statute of Limitations#
These Terms and any Claims are governed by the laws of Wisconsin, United States. These Terms and any Claims are not governed by the conflict of law rules of any jurisdiction, the United Nations Convention on Contracts for the International Sale of Goods, or the Uniform Computer Information Transactions Act, and the application of each is expressly excluded.
Any Claim that is not subject to arbitration, or cannot be heard in small claims court, will be resolved exclusively in the state or federal courts of Dane County, Wisconsin, United States. You and PerBlue waive any objection to venue in any such courts.
If you are a consumer in the European Union or the United Kingdom, this does not take away the protection of mandatory provisions of the law of your country of residence.
19. Miscellaneous#
If any provision of these Terms is held to be unenforceable, it will be construed so as to be enforceable to the maximum extent permissible by law, and the remaining Terms will remain in full force and effect. The failure of PerBlue to enforce any provision of these Terms will not be deemed a waiver of that provision.
You may not assign or transfer these Terms, in whole or in part, by operation of law or otherwise, without PerBlue's prior written approval. All of our rights and obligations under these Terms are freely assignable or transferable by us in connection with a merger, acquisition or sale of assets, or by operation of law or otherwise.
No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by these Terms.
These Terms (including Appendices A and B), our Privacy Policy, and any Other Governing Agreements that apply to you are the entire agreement between you and PerBlue about the Products. They supersede any earlier terms for Parallel Kingdom 2, including the parallelkingdom.com signup terms.
You agree that the provisions in these Terms that limit liability and disclaim warranties are essential terms of these Terms.
The section titles in these Terms are for convenience only and have no legal or contractual effect. Except as set forth in Section 20, there are no third-party beneficiaries to these Terms.
Please contact us at [email protected] for general questions and game support, and at [email protected] for legal notices, privacy requests, appeals and contest questions. Our address is PerBlue Entertainment, Inc., 821 E Washington Ave, Suite 200, Madison, WI 53703, USA.

In the event of any failure of the iOS version of our app to conform to any applicable warranty that has not been effectively disclaimed by these Terms, you may notify Apple, and Apple will refund the purchase price for our app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to our app. As between Apple and PerBlue, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be PerBlue's responsibility, but only to the extent provided by these Terms. Please read the entire Terms, as other sections of these Terms limit PerBlue's liability in this regard.
Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them. There are no other third-party beneficiaries of these Terms.
If you obtain our app from Google Play, your use of it is also subject to Google Play's terms, and Google is not responsible for our app.

When a message is reported, we keep a copy with the report. By using chat, you consent to this (§4(C)). Do not share passwords, sign-in links, API credentials, payment details, ID numbers or your home address in chat.
Part 3. Names#
These rules apply to character names, plot names, account aliases, and any other name you choose.
Format. Character names are 3 to 24 characters. They may use letters, numbers, spaces, apostrophes, underscores and hyphens, and must start with a letter or number. Plot names are 2 to 40 characters. Character names must be unique while the character is live.
Not allowed. A name may not:
- be hateful, obscene, sexual, violent or harassing, or contain slurs, including slurs that are misspelled, spaced out or coded;
- impersonate a real person, another player, a PerBlue employee or a moderator, or suggest you are official (for example "Admin", "PerBlue", "Support" or "Moderator");
- contain personal information, such as someone else's real full name, or a phone number, email address, street address or social media handle;
- name or point to a real-world place in a way that targets, mocks or harasses the people there;
- infringe a trademark or other rights, or use a brand or celebrity's name to suggest an endorsement;
- advertise a website, service, real-money trading or account selling; or
- be designed to evade the filter or these rules.
Our filter rejects some names automatically. We may rename a character or plot, or reset or remove a name, at any time. A plot's name may lapse when the plot changes hands.
Original Parallel Kingdom names. If you played the original Parallel Kingdom (2008), you may be able to reclaim a character name you used there:
- Matching email. If the email on your Parallel Kingdom 2 account matches the email registered to the original character, you can claim the name directly.
- Different email. If your original email is different, enter it and we will send a confirmation link to that address. We show the same response whether or not it matches, so the form cannot be used to discover other people's emails.
- Manual review. If you no longer have that email, you can ask for manual review. Tell us what you remember. Never send passwords, ID documents or payment details.
Further rules for reclaimed names:
- One account may hold up to 5 reclaimed names.
- When two people claim the same name, we review the claims, and our decision is final.
- A reclaimed name is a name in Parallel Kingdom 2 only.
- Reclaiming opens in phases, and unclaimed names may later become available to everyone.
- Do not try to claim a name that was not yours.
Part 4. Chat and conduct#
Parallel Kingdom 2 is for adults, and rivalry is part of the game. Attacking the person behind the character is not.
Not allowed in chat, messages, names, profiles, trade listings or anything you post:
- Harassment and bullying:
- targeting someone with repeated unwanted messages;
- following someone after they have asked you to stop or have blocked you;
- encouraging others to pile on; or
- telling someone to harm themselves.
- Hate: attacking or demeaning people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, age, disability or serious illness, including through slurs, symbols or coded language.
- Threats and violence: threats of real-world harm, or support for violent extremist groups or attacks.
- Sexual content: sexually explicit material, sexual solicitation of other players, and any sexual content involving minors. We report sexual content involving minors to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
- Doxxing and location abuse:
- posting or asking for anyone's real name, address, workplace, school, phone number, email, social media or photos without their permission;
- saying or implying that a character's in-game location is where a real person lives or is;
- tracking a player's characters to try to work out where they are in real life; and
- asking someone to meet, or going to where you believe they are, after they have said no.
- Impersonation: posing as PerBlue staff, a moderator, another player or a public figure.
- Scams and cheating:
- phishing for sign-in links or API credentials;
- trade scams that rely on lying outside the game's trade rules;
- buying or selling accounts, characters, items or currency for real money; and
- "boosting" services.
- Spam: repeated or automated messages, advertising, unwelcome referral links, and chain messages.
- Illegal activity: buying or selling illegal goods, gambling for real money, or encouraging anyone to break the law, trespass or put themselves in danger.
- Evading moderation: making new accounts or characters to get around a mute or ban, or misspelling words to get past the filter.
Profanity. Our filter masks common profanity and rejects slurs. Some channels may have stricter rules, which we show in the game.
Safety. If someone says they may hurt themselves or someone else, report it. If someone is in immediate danger, contact local emergency services. We may share information with emergency services when we believe someone's life or safety is at risk.
Part 5. The map and the real world#
- Never play while driving. Watch your surroundings. Do not trespass, or go anywhere unsafe or closed to the public, because of the game.
- You never have to go anywhere. Your characters' locations are virtual. Nothing in the game requires you to visit a real place or meet another player.
- Respect real places. Do not name or decorate plots, or arrange buildings, walls or decorations, to spell slurs, draw hateful or sexual symbols, or target a real place or community.
- Think before placing characters at places that matter to you. Other players can see your characters' in-game locations and your land.
- Property owners can ask us to change or remove a place (§9(B)).
Part 6. Automation and the API#
- Use only what we allow. Automation is allowed only through an API we offer, and only within the Terms and any API rules and limits we publish (§5(E)).
- You answer for your account. Everything done through your account, by you or by any tool you use, counts as yours, and it must follow these rules, including the chat rules.
- No scraping or simulated input. Do not scrape the website or app, simulate taps, use undocumented endpoints, or collect other players' information beyond what you need to play.
Part 7. Reporting and blocking#
- Report a message, name or player from the game's report menu, with a reason (spam, harassment, hate, cheating or other) and any details. We keep a copy of a reported message with the report.
- Automatic hiding. A message reported by several different players may be hidden automatically until a moderator reviews it.
- Block a player to stop seeing their messages and to stop them messaging you. You can also limit who may send you direct messages, including no one.
- Report bugs and exploits to [email protected] instead of using them. Reporting an exploit promptly is never held against you.
- False reports and reports made to harass someone are themselves a violation.
Part 8. Enforcement#
We decide what violates these rules, considering context and history. Depending on what happened, we may:
- warn you;
- remove or hide content;
- rename a character or plot, or take a name back;
- mute you in chat (for example, for 24 hours) or slow a channel;
- remove items, currency or progress gained by breaking the rules, and reverse trades;
- limit or revoke API access;
- suspend your account for a period; or
- permanently ban your account and any related accounts.
Serious violations, such as threats, sexual content involving minors, doxxing or real-money fraud, can lead to an immediate permanent ban, and may be reported to law enforcement.
Appeals. Appeals are handled under Section 14. A person will review your appeal. We may not be able to share details about other players.
Appendix B. Promotions and Referral Program Official Rules#
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Part 1. General rules for all promotions#
- What these rules are. These Official Rules are part of the Terms. Each contest, referral program or other promotion we run has a Schedule below (each, a "Schedule"). The Schedule gives the promotion's sponsor, dates, eligibility, rewards and any special rules. These Official Rules, including the Schedule, are the "Rules" for that promotion.
- Order of precedence. For a promotion, its Schedule governs over Part 1, and the Rules govern over Sections 1 to 20 of the Terms. Section 17 (Arbitration) always applies.
- Rules are fixed once a promotion opens. The version of the Rules in effect when a promotion opens governs that promotion until it ends and its rewards are delivered. Later changes to the Terms, or to these Official Rules, do not change the Rules of a promotion that is already open, except as Part 1, item 11 allows. Each Schedule shows its own version date, and we keep earlier versions available on our website.
- Sponsor. Unless a Schedule says otherwise, the sponsor is PerBlue Entertainment, Inc., a Delaware corporation, 821 E Washington Ave, Suite 200, Madison, WI 53703, USA ("Sponsor").
- Eligibility. Unless a Schedule says otherwise, promotions are open only to individuals who, at the time of entry:
- are at least 18 years old (or the age of majority where they live, if older);
- are legal residents of the 50 United States and the District of Columbia;
- have a Parallel Kingdom 2 account in good standing with a confirmed email address; and
- are not employees, officers, directors, contractors or agents of PerBlue, its affiliates, or anyone involved in running the promotion, or members of their immediate family (spouse, parents, siblings, children and their spouses) or household.
One account and one entry per person. Void where prohibited or restricted by law.
- Verification. We may verify eligibility at any time, including by asking for proof of age and residence. We may disqualify anyone who does not respond within 7 days.
- Fair play. We may disqualify an entrant, void their entries or referrals, and withhold or reverse any reward if we reasonably believe the entrant, or someone acting for them:
- used more than one account, or fake, temporary or disposable email addresses, address variations (for example "+tags" or dots), or other people's identities;
- referred themselves;
- bought, sold, traded or rewarded signups, used paid traffic, or incentivized signups with money or anything else of value;
- used bots, scripts, click farms or other automation to enter or to generate referrals;
- sent spam, or misled people about what they are signing up for;
- used PerBlue or Parallel Kingdom names, logos or art in ads, domains or social accounts made to look official;
- tampered with entry, the leaderboard or the Products; or
- otherwise broke these Rules or the Terms.
Sharing an internet connection (for example a household, school or workplace) is not by itself proof of fraud.
- Rewards. Rewards are Virtual Currency or Virtual Items (Section 6), such as Food credit, unless a Schedule says otherwise. Rewards:
- are not cash and have no cash value;
- cannot be sold, transferred or exchanged for cash or anything outside the game; and
- are cancelled, with no cash or substitute owed, if Parallel Kingdom 2 is cancelled or does not launch.
No substitution except by Sponsor, which may substitute a reward of equal or greater value.
- Taxes. Winners are responsible for any taxes on rewards. Where the law requires, we may ask a winner for tax information (for example, IRS Form W-9) before delivering a reward with an approximate retail value of $600 or more, and may report the reward to tax authorities. A winner who does not provide required information may forfeit the reward.
- Privacy and publicity. We use entrants' information to run promotions as described in our Privacy Policy. Unless prohibited by law, we may publish winners' names or aliases, as shown on the leaderboard, and their reward amounts.
- Changes, cancellation and errors. We may modify, suspend or cancel a promotion if any of the following harms its fairness or operation: fraud, technical problems, a change in law, or anything else beyond our reasonable control. Changes will not reduce rewards already earned under the published Rules, except to correct fraud or error. We are not responsible for lost, late, misdirected or incomplete entries, or for email delivery problems. Leaderboards are provisional. If an error would award more than intended, only the correct rewards will be granted.
- Release. By entering, entrants release PerBlue and its affiliates, officers, directors, employees and agents from claims arising from the promotion or any reward, to the extent permitted by law. Sections 13, 15, 16, 17 and 18 of the Terms apply. The Rules are governed by the laws of Wisconsin, USA.
- Disclose your connection. When you share a referral link, say that you may receive a reward if people join through it.
- Contact and winners list. Questions: [email protected]. For a winners list, email that address within 90 days after a promotion is settled, naming the promotion.
Schedule B-1. Founders' Referral Contest#
Version: November 1, 2026.
B-1.1 Contest period. The contest begins at 12:00 p.m. Central Time on November 1, 2026 and ends at 11:59 p.m. Central Time on January 31, 2027 (the "Contest Period"). Sponsor's server clock is the official timekeeper.
B-1.2 Eligibility. As in Part 1, item 5: residents of the 50 United States and the District of Columbia, 18 or older.
B-1.3 How to enter. During the Contest Period:
- create a free Parallel Kingdom 2 account at parallelkingdom.com;
- confirm your email address; and
- enroll in the contest and accept these Rules.
You then get a personal share link (your "Link"). Opting in to marketing email is not required.
B-1.4 Qualified Referrals. You earn credit only for Qualified Referrals. A Qualified Referral is a person who:
- visits the site through your Link and confirms that Link when they enroll (we remember the first valid Link a visitor used for up to 30 days, using a first-party cookie);
- is a new, real, eligible individual who did not already have a Parallel Kingdom 2 account or signup before visiting your Link;
- creates an account, confirms their email address and enrolls during the Contest Period; and
- passes our eligibility review (B-1.8).
Each person can be a Qualified Referral for only one entrant. Only direct referrals count. There is no credit for referrals made by people you referred, for clicks or visits, or for purchases. You cannot refer yourself.
The public leaderboard is not the official count. It shows confirmed signups through each Link as they happen, and it is provisional. It may include signups that later turn out not to qualify. Only the official count of Qualified Referrals made at settlement decides rewards.
B-1.5 The reward pool. The total pool depends on the number of Qualified Referrals made by all entrants combined during the Contest Period ("Total Qualified Referrals"):
| Total Qualified Referrals | Total pool (Food credit) |
|---|---|
| fewer than 10,000 | no pool; no rewards |
| 10,000 or more | $10,000 |
| 25,000 or more | $50,000 |
| 100,000 or more | $150,000 |
Only the highest level reached applies. The pool never exceeds $150,000 of Food credit.
B-1.6 How the pool is shared. Each entrant's reward is a per-referral amount, plus a place grant for the top 250 places:
| Pool $10,000 | Pool $50,000 | Pool $150,000 | |
|---|---|---|---|
| Per Qualified Referral | $0.10 | $0.25 | $0.50 |
| 1st place | $1,500 | $5,000 | $15,000 |
| 2nd | $1,000 | $3,500 | $10,000 |
| 3rd | $700 | $2,500 | $7,000 |
| 4th | $500 | $1,750 | $5,000 |
| 5th | $400 | $1,250 | $3,500 |
| 6th | $300 | $900 | $2,500 |
| 7th | $250 | $700 | $2,000 |
| 8th | $200 | $550 | $1,500 |
| 9th | $175 | $450 | $1,250 |
| 10th | $150 | $400 | $1,000 |
| 11th to 100th (each) | $25 | $200 | $400 |
| 101st to 250th (each) | $5 | $40 | $100 |
Places are ranked by Qualified Referrals. Rewards are computed in three steps:
- Place grants are paid first. Tied entrants share equally the grants for all the places they occupy together.
- The per-referral amount is paid next. If paying it in full would push the total over the pool, it is reduced pro rata so the total equals the pool.
- Any remainder is shared by referral count, so the whole pool is granted.
Amounts are computed in whole cents of Food credit. Leftover cents go to the largest fractional remainders, then by order of enrollment. There is no element of chance.
B-1.7 Food credit and delivery.
- Conversion. Food credit is stated in U.S. dollars only to show how much Food it buys: $1.00 of Food credit = 100 Food, the standard store rate.
- Delivery. Rewards are credited as Food to the winner's Parallel Kingdom 2 account within 30 days after the later of settlement and public launch.
- Claiming. To receive a reward, you must sign in with the account you entered with and accept the Terms in force at that time.
- Deadline. Rewards not claimed within 12 months after delivery opens are forfeited.
- Cap. No per-person cap beyond the table above
- Approximate retail value. equal to the dollar amount of Food credit, for tax reporting only.
B-1.8 Review, results and appeals. For 7 days after the Contest Period ends, we review entries. We then post provisional results and allow at least 7 days for appeals, sent to [email protected]. Final results are settled no sooner than 14 days after the Contest Period ends, and settlement may wait while any account is under review. Our decisions are final, except as required by law.
B-1.9 What is public.
- Your name on the leaderboard. The leaderboard shows your rank, your count, and your Parallel Kingdom name only if you turned on "Show my PK name". Otherwise it shows your alias.
- Your referral tree. A friend's name appears in your tree only if they chose to share it with you.
- Email addresses are never shown.
B-1.10 Invitation text. The invitation text the site gives you says that you may receive Food credit if someone joins through your Link. Do not remove that sentence.
Campaign site and signup terms#
These notes cover the campaign pages on parallelkingdom.com: the interest list, reserving an account, original-name requests and the share contest. They are part of the Terms above and only add detail. If anything here conflicts with Sections 1 to 20 or Appendix B, those govern.
- Who can sign up. You must be 18 or older (Section 1). Use one account, for yourself, with an email address you control (Section 2(A)).
- What signup does and doesn't do. Signing up and reserving are free and need no payment card. Signup doesn't buy anything, guarantee playtest or beta access, reserve land, or promise a release date. Parallel Kingdom 2 is in development, and images and footage may change (Section 5(A)).
- Email is optional. The interest list and development updates are optional and separate from sign-in, verification and account-security emails (Section 2(C)). Changing your email preferences or unsubscribing never affects your eligibility or referral credit.
- The interest list isn't contest entry. Contests and referral rewards are governed only by the Official Rules in Appendix B and each promotion's Schedule. Anything this site shows about rewards before a promotion opens, on the homepage or the campaign details page, is a preview: amounts, dates and how rewards are shared may change, and nothing is earned from it. If the site and a Schedule differ, the Schedule governs.
- Food credit, not cash. Referral and contest rewards are in-game Food credit (Section 8; Appendix B, Part 1, item 8). Food is a game currency, not cash, groceries or an investment. It has no cash value, and free promotional Food and credits are cancelled if Parallel Kingdom 2 does not launch. When you share your link, say that you may receive Food credit if people join through it (Appendix B, Part 1, item 13).
- Fair referrals. Only real, eligible new people who confirm their email address count, and only your direct referrals. Clicks, purchases, duplicates, self-referrals and friends of friends don't. Standings are provisional until review (Schedule B-1). Friends see your Parallel Kingdom name only if you show it, you see theirs only if they share it, and email addresses are never shown.
- Original names. Reclaiming a name from the original Parallel Kingdom needs verification under Appendix A, Part 3, and a request isn't approval. An alias or nickname you choose on this site may be moderated, and it doesn't establish a claim to an original name. Original accounts, items, Food, purchases, progress, hats and territory don't carry over (Section 2(A)).
- No payments here. This site doesn't take payments. If Food is ever sold before launch, the presale's own terms will cover delivery, any bonus Food and the launch date, and presale purchases will be refunded or credited if Parallel Kingdom 2 never launches (Section 7(C)).
- Questions. Write to [email protected] with questions, and to [email protected] for legal notices, privacy requests and contest questions (Section 19).
